Recoveries in Ponzi Schemes
Where a debtor has promoted a Ponzi scheme prior to their insolvency there is generally little, if any, assets initially available to an insolvency practitioner upon their appointment. There normally a large number of creditors and associated criminal investigations or prosecutions underway. The initial contributors to the scheme have commonly received more in return than they invested, whilst there is generally a larger number of creditors who have received less than they have contributed or nothing.
This session, presented by Dr. Neil Hannan, Partner at Thomson Geer, will explore possible recoveries that are available to liquidators and trustees in bankruptcy where the debtor has been involved in the promotion of a Ponzi Scheme.
