The Treasury Laws Amendment (Combating Illegal Phoenixing) Act 2019 (Cth)
The Treasury Laws Amendment (Combating Illegal Phoenixing) Act 2019 (Cth) (Act) came into operation on 18 February 2020. The Act:
- introduces new phoenix offences;
- introduces a new recovery power for ASIC;
- extends the recovery provisions available to liquidators to attack pre-liquidation disposition;
- introduces measures designed to prevent directors improperly backdating resignations, or ceasing to be a director, when this would leave the company with no directors to avoid liability or prosecution;
- extends the director penalty provisions to GST and related liabilities; and
- expands the ATO's power to withhold refunds where there are outstanding tax lodgements.
Scott Butler, Restructuring and Insolvency Partner at McCullough Robertson, will explain in detail how the measures introduced by the Act operate.
